Important: By purchasing, using, or presenting a guest pass, the Purchaser, Guest, and Host Member agree to these Terms and Conditions. Guests enter and use the premises at their own risk. Trading Card Gallery ("TCG") is not responsible for lost, stolen, or damaged personal property except as required by applicable law.
BY PURCHASING, USING, OR PRESENTING A GUEST PASS, THE PURCHASER, GUEST, AND HOST MEMBER AGREE THAT THE GUEST'S USE OF THE PREMISES IS VOLUNTARY AND THAT THE GUEST ASSUMES THE RISKS ASSOCIATED WITH ENTERING AND USING THE PREMISES. TO THE FULLEST EXTENT PERMITTED BY WASHINGTON LAW, THE GUEST AGREES TO RELEASE TCG FROM CLAIMS ARISING FROM ORDINARY NEGLIGENCE.
THIS RELEASE DOES NOT APPLY TO GROSS NEGLIGENCE, RECKLESS CONDUCT, WILLFUL MISCONDUCT, INTENTIONAL ACTS, OR ANY RIGHTS THAT CANNOT LEGALLY BE WAIVED UNDER APPLICABLE LAW.
For purposes of these Terms and Conditions:
"Guest" means the individual who enters or uses the Premises under a purchased Guest Pass.
"Purchaser" means the individual who purchases the Guest Pass.
"Host Member" means the active Silver or Gold keycard-holding member who sponsors, accompanies, admits, or otherwise assumes responsibility for the Guest and whose membership is active, paid, unsuspended, and in good standing.
"Minor Guest" means any Guest under eighteen (18) years of age who has received prior approval from TCG management.
"Premises" means the interior areas leased, operated, or actually controlled by TCG, including designated play areas, approved common areas, restrooms, and entryways. Premises does not include parking areas, sidewalks, shared shopping-center common areas, or other locations not owned, leased, operated, or actually controlled by TCG.
"Guest Pass Period" means the twenty-four (24) consecutive hours beginning at the recorded time of successful purchase and ending exactly twenty-four (24) hours later, unless the Guest Pass is revoked or terminated earlier under these Terms.
· Guest Passes are revocable, limited licenses that permit temporary entry to designated portions of the Premises only during the Guest Pass Period.
· The Guest Pass Period begins at the recorded time of successful purchase and expires exactly twenty-four (24) hours later. The Guest Pass is not extended because of late arrival, nonuse, temporary absence, or the unavailability of the Host Member.
· Purchase of a Guest Pass does not create a membership, tenancy, bailment, ownership interest, or continuing access right.
· A Guest must remain accompanied by the Host Member at all times unless TCG expressly authorizes otherwise in writing.
· No keycard, access code, key, or independent after-hours credential will be issued or provided to a Guest.
· Guest Passes are valid only for the individual identified during purchase or check-in and may be used only with the designated Host Member.
· Guest Passes are non-transferable and may not be sold, assigned, copied, shared, or otherwise transferred.
· Guest Passes are non-refundable once purchased unless otherwise required by law or expressly approved by TCG.
· The Guest represents that the Guest is at least eighteen (18) years of age unless prior approval has been obtained from TCG management under Section 10.
· TCG may verify Guest Pass information, purchase information, account information, Host Member status, and eligibility using available records. TCG does not require a Guest to provide photo identification as a condition of online Guest Pass purchase.
· TCG may refuse, suspend, revoke, or terminate access for any lawful reason, including safety concerns, policy violations, suspected fraud, false age or eligibility representations, incomplete purchase information, or capacity limitations.
· Guest Passes may only be used with a Host Member in good standing. TCG may deny Guest access if the Host Member's membership is suspended, restricted, delinquent, revoked, or otherwise not in good standing.
Any individual previously banned, suspended, trespassed, or removed from TCG Premises may not use a Guest Pass without prior written authorization from TCG management.
· For online purchases and electronic Guest Passes:
· Checking an acceptance box, completing payment, submitting an order, receiving a Guest Pass, presenting a Guest Pass, accompanying a Guest onto the Premises, or entering under a Guest Pass constitutes electronic acknowledgment and acceptance of these Terms to the fullest extent permitted by law.
· The Purchaser represents that all information provided is accurate and complete and that the Purchaser is authorized to purchase the Guest Pass for the named Guest.
· The Guest and Host Member each represent that they have read, understood, and voluntarily agree to these Terms before the Guest enters or uses the Premises.
· The Host Member's act of admitting, accompanying, or remaining with the Guest constitutes the Host Member's acceptance of these Terms and acknowledgment of responsibility for the Guest as stated herein.
· TCG may cancel or deny use of any Guest Pass obtained through inaccurate information, suspected fraud, payment reversal, chargeback activity, false eligibility representations, or misuse of promotional offers.
· A Guest Pass grants temporary access only to the areas, activities, dates, and times designated by TCG and only while the Guest is accompanied by the Host Member.
· Access to staff-only, inventory, storage, office, cash-wrap, receiving, restricted, or otherwise designated non-public areas is prohibited.
· A Guest Pass does not provide membership status and does not include any Silver or Gold Membership benefits. Guest Pass holders are not eligible for membership loyalty points, enhanced cash-buy or trade-credit rates, free or discounted tournament entry, prerelease product or event access, independent keycard access, purchase priority, member-only offers, or any other membership benefit.
· A Guest Pass does not guarantee event participation, seating, product availability, reservation priority, tournament entry, admission to special or limited-capacity events, or continued access during closures or interruptions.
· Tournament fees, event fees, products, merchandise, food, and other purchases are not included in the Guest Pass price unless expressly stated at the time of purchase.
· Guests and Host Members must comply with all posted store rules, event rules, occupancy limits, safety requirements, staff instructions, access procedures, and applicable laws.
· TCG may modify house rules, access procedures, and operational policies at any time. Immediate changes may be made for safety, security, legal compliance, fraud prevention, or operational needs.
Guests, Purchasers, and Host Members may not engage in, permit, or assist with any of the following on the Premises:
· Illegal activity, theft, attempted theft, fraud, deception, or chargeback abuse.
· Threatening, abusive, harassing, intimidating, discriminatory, dangerous, or disruptive conduct.
· Damage, vandalism, alteration, misuse, or unauthorized removal of TCG property.
· Entry into unauthorized areas or admission of unauthorized persons.
· Circumvention, disabling, obstruction, or misuse of locks, doors, alarms, cameras, access controls, or other security systems.
· Remaining after the Guest Pass Period or after the Host Member leaves.
· Unauthorized commercial activity, private events, gambling prohibited by law, sleeping, overnight occupancy, or storage of personal property.
· Possession, carrying, display, use, or transfer of any firearm, knife intended or carried as a weapon, explosive, or other weapon, except by on-duty law-enforcement personnel acting within the scope of their duties or as otherwise required by applicable law.
· Possession, use, consumption, sale, distribution, or transfer of alcohol.
· Possession, use, consumption, sale, distribution, or transfer of tobacco or nicotine products, including cigarettes, cigars, chewing tobacco, nicotine pouches, electronic cigarettes, vapor devices, cartridges, or related products.

· Possession, use, sale, distribution, or transfer of illegal drugs or unlawful controlled substances.
· Audio or video recording in violation of applicable law or recording that interferes with store operations, privacy, security, events, or safety.
TCG may immediately remove, ban, suspend, revoke access, or issue a trespass notice for any actual or suspected violation. A Guest's violation may also constitute a violation by the Host Member and may result in suspension or termination of the Host Member's membership privileges.
· Guests are permitted access only while accompanied by their Host Member.
· The Host Member must remain physically present with the Guest throughout the Guest's use of the Premises, including during unstaffed hours.
· The Host Member is responsible for ensuring compliance with all access-control procedures and for ensuring that exterior doors close and latch after entry and exit.
· The Host Member may not provide keys, access credentials, access codes, keycards, or other access devices to any Guest.
· The Host Member and Guest must enter and exit together. The Host Member is responsible for ensuring that the Guest exits when the Host Member exits and no later than the expiration of the Guest Pass Period.
· Tailgating, door-propping, unauthorized entry, and admission of unauthorized persons are prohibited.
· The Host Member accepts responsibility for the Guest's conduct, compliance with rules, and use of the Premises during the Guest Pass Period.
· Unauthorized guest access includes entry without a valid Guest Pass, entry outside the Guest Pass Period, use of another person's Guest Pass, use with a Host Member who is not present or not in good standing, entry into restricted areas, or admission of any additional person who does not have a valid Guest Pass or other authorization.
· The Host Member may be assessed an Unauthorized Guest Fee of fifty dollars ($50.00) per unauthorized person, per day, in addition to suspension or termination of membership, revocation of access, removal, trespass action, and recovery of other losses or damages.
· Purchasing a Guest Pass after unauthorized entry has occurred does not waive the Unauthorized Guest Fee or cure the prior violation unless TCG expressly agrees in writing.
· The Unauthorized Guest Fee supplements and does not limit TCG's right to recover documented property damage, theft losses, cleanup costs, security costs, or other lawfully recoverable amounts.
Guests acknowledge that use of a retail and play-space environment may involve risks, including but not limited to:
· Slips, trips, and falls.
· Collisions with fixtures, furniture, products, or patrons.
· Product-related hazards and accidental injuries.
· Illness exposure and risks associated with crowded environments.
· Risks associated with periods when staff may not be present.
· Theft, property loss, and security incidents.
The Guest voluntarily assumes all ordinary risks associated with entering and using the Premises.
· To the fullest extent permitted by Washington law, the Guest releases and waives claims against TCG and its owners, members, managers, employees, contractors, agents, successors, and assigns for ordinary negligence arising from the Guest's voluntary use of the Premises.
· Nothing in these Terms releases claims involving gross negligence, reckless conduct, willful misconduct, intentional wrongdoing, or non-waivable statutory rights.
· TCG is not responsible for lost, stolen, misplaced, or damaged personal property, including cards, decks, binders, collectibles, electronics, bags, cash, apparel, and other belongings, except as required by law.
· No bailment is created by allowing personal property onto the Premises.
· TCG does not guarantee continuous access, internet availability, event availability, staffing levels, product availability, seating, or compatibility with any event or activity.
· If a Guest or Host Member becomes aware of a potentially unsafe condition, the Guest and Host Member should avoid or exit the affected area and promptly notify TCG.
· The Guest, Purchaser, and Host Member may be held jointly and severally responsible for documented losses caused by the Guest's or Host Member's conduct, including theft, property damage, excessive cleanup, unauthorized access, fraud, chargebacks, service disruptions, and losses caused by persons admitted by the Guest or Host Member.
· TCG may assess reasonable and documented charges for cleanup, repairs, replacement, restoration, third-party services, collection costs, and other lawfully recoverable amounts. TCG may provide an itemized invoice and supporting documentation where reasonably practicable.
· The Purchaser authorizes TCG to charge the payment method used for purchase for documented and lawfully owed amounts arising under these Terms, to the extent permitted by the applicable payment authorization and law, including damage charges, cleanup costs, chargeback-related losses, collection costs, and unpaid balances.
· To the fullest extent permitted by law, the Guest, Purchaser, and Host Member agree to indemnify and hold harmless TCG from third-party claims, losses, damages, liabilities, costs, and reasonable attorneys' fees to the extent arising from violations of these Terms, theft, property damage, unauthorized access, injury caused by the Guest, or other third-party claims caused by the Guest's or Host Member's conduct. This obligation does not apply to the extent a claim is caused by TCG's gross negligence, reckless conduct, willful misconduct, or intentional wrongdoing.
· No person under eighteen (18) years of age may enter, remain on, or use the Premises as a Guest without prior approval from TCG management.
· Approval must be obtained before the Minor Guest enters the Premises. Purchase of a Guest Pass does not itself constitute approval.
· TCG may require written consent from a parent or legal guardian, emergency contact information, specific supervision arrangements, and acceptance of financial responsibility for damages caused by the Minor Guest.
· Nothing in these Terms is intended to waive or release any right or claim of a Minor Guest that cannot legally be waived under Washington law.
· The parent or guardian, accompanying adult, and Host Member remain responsible for supervision, conduct, damages, fees, theft, losses, and rule compliance involving the Minor Guest.
· If TCG reasonably believes emergency assistance is necessary, TCG may contact emergency medical services, law enforcement, emergency contacts, or the parent or guardian of an approved Minor Guest. The Guest, Purchaser, and Host Member remain responsible for resulting medical, transportation, or related expenses.
· During an emergency, the Guest and Host Member should call 911 when appropriate, leave the affected area, follow posted emergency procedures, and notify TCG as soon as reasonably possible.
· TCG may collect and retain information provided during purchase or check-in for payment processing, access control, fraud prevention, security investigations, incident response, and legal compliance.
· TCG utilizes video surveillance in portions of the Premises for safety, security, theft prevention, access control, and incident review. Guests acknowledge that common areas may be monitored by security cameras.
· Any audio recording by TCG, if utilized, will be conducted only as permitted by applicable law.
· Use of TCG's website may also be governed by TCG's Privacy Policy and Website Terms of Use.
· TCG welcomes service animals as required by applicable law.
· When it is not obvious that an animal is a service animal, TCG may ask only whether the animal is required because of a disability and what work or task the animal has been trained to perform, as permitted by law.
· The handler remains responsible for the animal's supervision, care, control, cleanup, and any damage caused by the animal.
· TCG may request removal of an animal that is out of control and the handler does not regain control, is not housebroken, poses a direct threat, or otherwise creates a lawful basis for removal.
· Nothing in these Terms is intended to limit rights or accommodations required by applicable disability-access laws.
· TCG may revoke, suspend, terminate, or deny access for any lawful reason, including rule violations, safety concerns, maintenance, emergencies, capacity limitations, staffing issues, fraud, chargebacks, or security concerns.
· Guest Passes are non-refundable for Guest or Host cancellation, no-show, late arrival, failure to use the Pass, false information, rule violations, removal, suspension, or the Host Member's inability to attend or remain present.
· If TCG cancels access before a Guest Pass is used, or if access becomes unavailable for reasons unrelated to the Guest, Purchaser, or Host Member, TCG may provide a refund, store credit, rescheduling opportunity, or comparable remedy at its discretion, except where applicable law requires otherwise.
· Use of a Guest Pass does not establish priority placement for product releases, tournaments, events, reservations, or waitlists.
· These Guest Pass Terms supplement and do not replace the Host Member's Membership Agreement.
· The Host Member remains fully bound by the Membership Agreement, including its guest, access-control, cleanup, damage, payment, suspension, and termination provisions.
· A Guest's violation of these Terms may also constitute a violation of the Host Member's Membership Agreement.
· If these Terms and the Membership Agreement conflict regarding guest access, security, safety, or conduct, the more restrictive requirement will apply. The Membership Agreement continues to govern the Host Member's membership account, membership fees, benefits, access credential, and membership status.
TCG will administer and enforce these Terms in a nondiscriminatory manner and in compliance with applicable federal, state, and local laws.
By purchasing, using, or presenting a guest pass, the Purchaser, Guest, and Host Member acknowledge that they have read, understood, and voluntarily agree to these Terms and Conditions.
The Purchaser, Guest, and Host Member further acknowledge the Liability Release, Assumption of Risk, and Financial Responsibility provisions contained herein.
