Guest Pass Terms and Conditions

 Hello and welcome! 


Here you may purchase a guest pass to access the Trading Card Gallery play area at 509 Grant Rd, East Wenatchee WA! This guest pass costs $10.00 (+tax) and is valid for 24 hours from the time of purchase. 


You must provide your first/last name as well as the first/last name of the member that is hosting you. You will not be issued a keycard, so you must remain with your host for re-entry. Each guest must purchase a guest pass. It is non-transferrable or refundable if unused.

Trading Card Gallery Guest Pass Terms and Conditions

Important: By purchasing, using, or presenting a guest pass, the Purchaser, Guest, and Host Member agree to these Terms and Conditions. Guests enter and use the premises at their own risk. Trading Card Gallery ("TCG") is not responsible for lost, stolen, or damaged personal property except as required by applicable law.


IMPORTANT LIABILITY RELEASE

BY PURCHASING, USING, OR PRESENTING A GUEST PASS, THE PURCHASER, GUEST, AND HOST MEMBER AGREE THAT THE GUEST'S USE OF THE PREMISES IS VOLUNTARY AND THAT THE GUEST ASSUMES THE RISKS ASSOCIATED WITH ENTERING AND USING THE PREMISES. TO THE FULLEST EXTENT PERMITTED BY WASHINGTON LAW, THE GUEST AGREES TO RELEASE TCG FROM CLAIMS ARISING FROM ORDINARY NEGLIGENCE.

THIS RELEASE DOES NOT APPLY TO GROSS NEGLIGENCE, RECKLESS CONDUCT, WILLFUL MISCONDUCT, INTENTIONAL ACTS, OR ANY RIGHTS THAT CANNOT LEGALLY BE WAIVED UNDER APPLICABLE LAW.


1. Definitions

For purposes of these Terms and Conditions:

  • "Guest" means the individual who enters or uses the premises under a purchased guest pass. 
  • "Purchaser" means the individual who purchases the guest pass. 
  • "Host Member" means the active keycard-holding member who sponsors, accompanies, admits, or otherwise assumes responsibility for the Guest. 
  • "Minor Guest" means any Guest under eighteen (18) years of age who has been specifically pre-approved by TCG management in advance. 
  • "Premises" means any area owned, leased, operated, or controlled by TCG, including designated play areas, common areas, restrooms, entryways, and parking areas under TCG control. 


2. Eligibility and Purchase Terms

  • Guest passes are revocable, limited licenses that permit temporary entry to designated TCG premises only during the approved guest-pass period. 
  • Purchase of a guest pass does not create a membership, tenancy, bailment, ownership interest, or continuing access right. 
  • A Guest must remain accompanied by the Host Member unless TCG expressly authorizes otherwise in writing. 
  • No keycard, access code, or independent after-hours credential will be issued to a Guest. 
  • Guest passes are valid only for the individual identified during purchase or check-in. 
  • Guest passes are non-transferable and may not be sold, assigned, copied, shared, or otherwise transferred. 
  • Guest passes are non-refundable once purchased unless otherwise required by law or expressly approved by TCG. 
  • Guests must be at least eighteen (18) years of age unless specifically pre-approved by TCG management. 
  • TCG reserves the right to verify identity, age, eligibility, and purchase information prior to granting entry. 
  • TCG may refuse, suspend, revoke, or terminate access for any lawful reason, including safety concerns, policy violations, suspected fraud, incomplete verification, or capacity limitations. 
  • Guest passes may only be used with a Host Member in good standing. TCG may deny guest access if the Host Member's membership is suspended, restricted, delinquent, revoked, or otherwise not in good standing. 
  • Any individual previously banned, suspended, trespassed, or removed from TCG premises may not use a guest pass without prior written authorization from TCG management.

 

3. Online Purchases and Electronic Acceptance

For online purchases:

  • Checking an acceptance box, completing payment, submitting an order, receiving a guest pass, or presenting a guest pass for use constitutes electronic acknowledgment and acceptance of these Terms and Conditions. 
  • The Purchaser represents that all information provided is accurate and complete. 
  • The Purchaser represents that they are authorized to purchase the pass for the named Guest. 
  • TCG may cancel or deny use of any pass obtained through inaccurate information, suspected fraud, payment reversal, chargeback activity, or misuse of promotional offers. 


4. Scope of Access and House Rules

  • A guest pass grants access only to areas, activities, dates, and times designated by TCG. 
  • Access to staff-only, inventory, storage, office, cash-wrap, restricted, or otherwise designated non-public areas is prohibited. 
  • A guest pass does not guarantee: 
    • Event participation 
    • Seating 
    • Product availability 
    • Reservation priority 
    • Tournament entry 
    • Admission to special or limited-capacity events 
  • Guests must comply with: 
    • Posted store rules 
    • Event rules 
    • Occupancy limits 
    • Safety requirements 
    • Staff instructions 
    • Applicable laws 
  • TCG may modify house rules, access procedures, and operational policies at any time. 


5. Conduct, Security, and Prohibited Activities

Guests may not:

  • Engage in illegal activity. 
  • Commit theft, attempted theft, fraud, or deception. 
  • Harass, threaten, intimidate, or discriminate against others. 
  • Damage, vandalize, alter, or misuse TCG property. 
  • Enter unauthorized areas. 
  • Admit unauthorized persons. 
  • Circumvent security systems or access controls. 
  • Remain after authorized access periods. 
  • Engage in unauthorized commercial activity. 
  • Conduct gambling activities prohibited by law. 
  • Possess weapons prohibited by law. 
  • Possess illegal drugs or unlawful controlled substances. 
  • Smoke or vape inside the premises. 
  • Consume alcohol unless specifically authorized by TCG for a particular event. 
  • Conduct audio or video recording without prior written approval from TCG management, except where prohibited by law. 

TCG may immediately remove, ban, suspend, revoke access, or issue a trespass notice for any actual or suspected violation.

A Guest's violation of these Terms may also constitute a violation by the Host Member and may result in disciplinary action against the Host Member, including suspension or termination of membership privileges.


6. Unstaffed Access and Host Responsibilities

Guests are permitted access only while accompanied by their Host Member.

When the premises are unstaffed:

  • The Host Member must remain present with the Guest. 
  • The Host Member is responsible for ensuring compliance with all access-control procedures. 
  • The Host Member may not provide keys, access credentials, access codes, or keycards to any Guest. 
  • The Host Member is responsible for ensuring the Guest exits when the Host Member exits. 
  • Tailgating, unauthorized entry, and admission of unauthorized persons are prohibited. 

The Host Member accepts responsibility for the Guest's conduct, compliance with rules, and use of the premises during the guest-pass period.


7. Assumption of Risk

Guests acknowledge that use of a retail and play-space environment may involve risks, including but not limited to:

  • Slips, trips, and falls 
  • Collisions with fixtures or patrons 
  • Product-related hazards 
  • Illness exposure 
  • Accidental injuries 
  • Risks associated with crowded environments 
  • Risks associated with periods where staff may not be present 

Guests voluntarily assume all ordinary risks associated with entering and using the premises.


8. Release and Limitation of Liability

To the fullest extent permitted by Washington law:

  • The Guest releases and waives claims against TCG and its owners, members, managers, employees, contractors, agents, successors, and assigns for ordinary negligence arising from the Guest's voluntary use of the premises. 
  • Nothing in these Terms releases claims involving: 
    • Gross negligence 
    • Reckless conduct 
    • Willful misconduct 
    • Intentional wrongdoing 
    • Non-waivable statutory rights 

TCG is not responsible for:

  • Lost property 
  • Stolen property 
  • Misplaced property 
  • Damaged personal property 

including cards, decks, binders, collectibles, electronics, bags, cash, apparel, and other belongings, except as required by law.

No bailment is created by allowing property onto the premises.

TCG does not guarantee:

  • Continuous access 
  • Internet availability 
  • Event availability 
  • Staffing levels 
  • Product availability 
  • Compatibility with any event or activity 

TCG will make reasonable efforts to maintain the premises in a safe condition; however, Guests acknowledge that staff may not be present during all access periods.

If a Guest or Host Member becomes aware of a potentially unsafe condition, they should immediately exit the affected area and notify TCG.


9. Damage, Theft, Financial Responsibility, and Indemnification

The Guest, Purchaser, and Host Member may be held jointly and severally responsible for losses caused by the Guest's conduct, including:

  • Theft 
  • Property damage 
  • Excessive cleanup 
  • Unauthorized access 
  • Fraud 
  • Chargebacks 
  • Service disruptions 
  • Losses caused by persons admitted by the Guest 

TCG may assess reasonable and documented charges for:

  • Cleanup 
  • Repairs 
  • Replacement 
  • Restoration 
  • Administrative handling 
  • Third-party services 

TCG may provide an itemized invoice and supporting documentation for charges where reasonably practicable.

The Purchaser authorizes TCG to charge the payment method used for purchase for documented and lawfully owed amounts arising under these Terms, including approved damage charges, cleanup costs, chargeback-related losses, collection costs, and unpaid balances.

The Guest, Purchaser, and Host Member agree to indemnify and hold harmless TCG from claims, losses, damages, liabilities, costs, and reasonable attorneys' fees arising from:

  • Violations of these Terms 
  • Theft 
  • Property damage 
  • Unauthorized access 
  • Injury caused by the Guest 
  • Claims brought by third parties arising from the Guest's conduct 


10. Minor Guests

No person under eighteen (18) years of age may use a guest pass without prior written approval from TCG management.

A parent or legal guardian may be required to:

  • Provide written consent 
  • Provide emergency contact information 
  • Acknowledge supervision requirements 
  • Accept responsibility for damages caused by the Minor Guest 

Nothing in these Terms is intended to waive or release any rights or claims of a Minor Guest that cannot legally be waived under Washington law.

The parent/guardian, accompanying adult, and Host Member remain responsible for supervision, conduct, damages, fees, theft, losses, and rule compliance involving the Minor Guest.


11. Health, Emergency, and Safety Response

If TCG reasonably believes emergency assistance is necessary, TCG may contact:

  • Emergency medical services 
  • Law enforcement 
  • Emergency contacts 
  • Parents or guardians of approved Minor Guests 

The Guest, Purchaser, and Host Member remain responsible for resulting medical, transportation, or related expenses.


12. Privacy, Security, and Surveillance

TCG may collect and retain information provided during purchase or check-in for:

  • Payment processing 
  • Identity verification 
  • Access control 
  • Fraud prevention 
  • Security investigations 
  • Incident response 
  • Legal compliance 

TCG utilizes video surveillance for safety, security, theft prevention, and incident review.

Any audio recording by TCG, if utilized, shall be conducted only as permitted by applicable law.

Guests acknowledge that portions of the premises may be monitored by security cameras.

Use of TCG's website may also be governed by TCG's Privacy Policy and Website Terms of Use.


13. Service Animals and Accessibility

TCG welcomes service animals as required by applicable law.

TCG may ask only those questions permitted by law to determine whether an animal qualifies as a service animal.

The handler remains solely responsible for:

  • Supervision 
  • Care 
  • Control 
  • Cleanup 
  • Damage caused by the service animal 

TCG reserves the right to request removal of a service animal that is out of control, poses a direct threat, is not housebroken, or otherwise creates a lawful basis for removal.

Nothing in these Terms is intended to limit rights or accommodations required by applicable disability-access laws.


14. Revocation, Closures, and Refunds

TCG may revoke, suspend, terminate, or deny access for any lawful reason, including:

  • Rule violations 
  • Safety concerns 
  • Maintenance 
  • Emergencies 
  • Capacity limitations 
  • Staffing issues 
  • Fraud 
  • Chargebacks 
  • Security concerns 

If TCG cancels access before a guest pass is used, or if access becomes unavailable for reasons unrelated to the Guest, Purchaser, or Host Member, TCG may provide a refund, store credit, rescheduling opportunity, or comparable remedy at its discretion.

Use of a guest pass does not establish priority placement for:

  • Product releases 
  • Tournaments 
  • Events 
  • Reservations 
  • Waitlists 


15. Nondiscrimination and Compliance with Law

TCG will administer and enforce these Terms in a nondiscriminatory manner and in compliance with applicable federal, state, and local laws.


16. Governing Law and Miscellaneous

These Terms and Conditions are governed by the laws of the State of Washington.

If any provision is found invalid or unenforceable, the remaining provisions shall remain in full force and effect.

These Terms, together with any posted rules, policies, event requirements, written approvals, website terms, and privacy policies, constitute the entire agreement governing guest-pass use.

No waiver of any provision shall be effective unless made in writing by TCG.


Acknowledgment

By purchasing, using, or presenting a guest pass, the Purchaser, Guest, and Host Member acknowledge that they have read, understood, and voluntarily agree to these Terms and Conditions.

The Purchaser, Guest, and Host Member further acknowledge the Liability Release, Assumption of Risk, and Financial Responsibility provisions contained herein.
