1. PLAN INFORMATION

2. MEMBERSHIP TERM, INITIAL PAYMENT, AND RECURRING BILLING

2.1 Calendar-Month Membership. Membership is sold on a calendar-month basis and continues month to month until canceled or terminated in accordance with this Agreement. Silver-Tier members will pay $24.99, Gold-Tier members will pay $39.99 per month. Applicable WA State taxes / transaction fees not included in membership pricing.

2.2 Full Initial-Month Payment. The full monthly fee for the selected tier is due when membership is activated, regardless of the activation date. Initial charges are not prorated. A Member who enrolls late in a month may be charged the full current-month fee and then another full monthly fee on the upcoming first day of the next month.

2.3 Automatic Renewal on the First. After the initial payment, membership automatically renews on the first calendar day of each month at the price then applicable to the selected tier, plus applicable taxes or fees, until canceled or terminated.

2.4 Payment Authorization. Member authorizes TCG and its payment processor to charge the payment method on file for recurring membership fees and other amounts lawfully due under this Agreement. Member must keep payment information current.

2.5 Failed or Reversed Payments. If a payment is declined, reversed, disputed, or charged back, TCG may immediately suspend membership, keycard access, loyalty benefits, event benefits, and all associated privileges until all amounts due are paid. TCG may remove unredeemed promotional benefits issued for a payment that is later reversed or charged back.

2.6 No Proration or Partial-Month Refunds. Except where this Agreement expressly provides otherwise or where required by law, TCG does not issue prorated or partial-month refunds for voluntary cancellation, nonuse, temporary loss of access caused by the Member, or unused benefits.

3. MEMBERSHIP BENEFITS AND LIMITATIONS

3.1 Active and Good Standing. Benefits are available only while the membership is active, fully paid, and in good standing. Membership and benefits are personal to the Member, nontransferable, and may not be sold, assigned, loaned, sublicensed, shared, or used on behalf of another person.

3.2 Silver Membership. Silver Membership includes only twenty-four-hour access to the designated TCG play area, subject to this Agreement, posted rules, access restrictions, temporary closures, and safety requirements. Silver Membership does not include loyalty points, tournament-entry benefits, enhanced buy/trade offers, or prerelease benefits.

3.3 Gold Monthly Loyalty Points. After successful monthly payment, TCG will load twenty (20) loyalty points to the Gold Member account once per paid calendar month. The points currently have a total redemption value of ten dollars ($10.00) under TCG’s loyalty program. Points are not cash, are not redeemable for cash, are nontransferable, and may not be duplicated by canceling and restarting during the same month. Use of points remains subject to TCG’s loyalty-program rules, product exclusions, and applicable expiration terms.

3.4 Gold Weekly Tournament Benefit. For each eligible standard weekly in-store tournament, TCG will waive up to five dollars ($5.00) of the Member’s entry fee. If the entry fee exceeds $5.00, the Member must pay the difference. Unless TCG expressly designates otherwise, this benefit excludes prerelease events, sealed-product events, leagues, special events, third-party events, and events whose entry fee includes products, kits, food, merchandise, or other items. The benefit does not guarantee a seat, reservation, priority placement, or admission after a registration deadline or capacity limit.

3.5 Gold Additional 5% Buy/Trade Benefit. For eligible transactions, TCG will add five percent (5%) to TCG’s final quoted base cash-buy or trade-credit offer. This is not 5% of market value, retail value, resale value, or the Member’s requested price. TCG may exclude bulk-rate purchases, consignment items, items TCG declines to purchase, counterfeit or altered items, stolen or unlawfully obtained property, transactions combined with another bonus promotion, and categories identified in a posted buylist policy. Member represents that Member owns each item offered and has the legal right to transfer it.

3.6 Gold Prerelease Opportunities. Gold Membership may provide eligibility for designated prerelease products, early purchasing opportunities, allocations, or events specifically announced by TCG. This benefit does not guarantee availability, quantity, price, allocation, event admission, or a right to purchase. Manufacturer, distributor, organized-play, product-limit, registration, and eligibility rules continue to apply. TCG may require separate payment for products, kits, or event entry and may prohibit transfer or circumvention of purchase limits.

3.7 No Stacking Unless Approved. Discounts, fee waivers, loyalty points, enhanced offers, and promotional benefits may not be combined with other offers unless TCG expressly permits the combination.

4. TIER CHANGES

4.1 Effective Date. Requested tier changes normally take effect on the first day of the following calendar month.

4.2 Immediate Upgrade. TCG may permit an immediate upgrade from Silver to Gold after payment of the difference between the Silver and Gold monthly fees. No prorated credit is issued for unused Silver Membership time. Gold benefits are issued only as determined by TCG for the upgrade month and may not be duplicated.

4.3 Downgrade. A downgrade from Gold to Silver takes effect on the first day of the following calendar month. Gold benefits already validly issued or redeemed remain subject to this Agreement and the applicable loyalty or event rules.

5. IDENTIFICATION, ACCOUNT ACCURACY, AND PRIVACY

5.1 Required Photo ID. Before either membership tier is activated, Member must present valid, unexpired government-issued photo identification. The name on the identification must match the membership account. TCG may require reverification and may refuse, delay, suspend, or terminate access if satisfactory identification is not provided.

5.2 Information Updates. Member must promptly update TCG regarding changes to name, home address, phone number, email address, emergency contact, or payment information.

6. FACILITY ACCESS AND AFTER-HOURS USE

6.1 Designated Areas Only. Membership permits access only to the designated play area, restrooms, and common areas approved by TCG. It does not authorize access to retail merchandise areas outside approved hours, behind-counter areas, offices, inventory or storage rooms, receiving areas, cash registers, point-of-sale equipment, employee-only spaces, or any area marked restricted.

6.2 Unstaffed Access. The play area may be unstaffed outside posted business hours. Member understands that no TCG employee, security officer, or emergency responder is guaranteed to be present and that after-hours use is at Member’s own risk.

6.3 Temporary Closures. TCG may temporarily restrict or suspend access for maintenance, cleaning, private events, emergencies, security incidents, weather, utility outages, construction, building-owner requirements, government orders, or any condition TCG reasonably believes presents a safety, operational, or property risk. Brief or reasonable closures do not create a refund right.

6.4 Emergency Procedures. Member must follow posted emergency procedures and call 911 during an emergency. Member must promptly report suspicious activity, property damage, access-system failures, or unsafe conditions to TCG.

6.5 No Tenancy or Storage Rights. Membership is a revocable license to use designated areas and does not create a lease, tenancy, lodging right, possessory interest, or right to store property. Sleeping, overnight occupancy, and leaving personal property unattended after departure are prohibited.

7. KEYCARDS AND ACCESS CREDENTIALS

7.1 TCG Property and Personal Use. Any keycard, code, mobile credential, or other access device remains TCG property and is issued solely for the Member’s personal use. Member shall not lend, share, copy, transfer, photograph for duplication, or permit another person to use the credential.

7.2 Door Security. Member must ensure secured doors fully close and latch, must not prop open a secured door, and must not admit any person who lacks authorized access or a valid guest pass.

7.3 Lost Keycard Replacement Fee. A lost or unreturned physical keycard will incur a thirty-dollar ($30.00) replacement fee. Member must report a lost or stolen keycard immediately so TCG can deactivate it. No replacement fee will be charged for a verified malfunctioning keycard that is returned to TCG, unless the malfunction resulted from misuse or damage.

7.4 Deactivation. TCG may immediately deactivate any credential for nonpayment, suspected misuse, unauthorized entry, safety concerns, property damage, rule violations, account termination, or any other reasonable security purpose.

8. GUEST POLICY

8.1 Guest Pass Required. Every guest must obtain a valid guest pass at the register, online, or through another method authorized by TCG before entering or using the play area. 

8.2 Member Responsibility. Member is responsible for each guest the Member admits, accompanies, or permits to enter, including the guest’s conduct, cleanup, property damage, and compliance with store rules.

8.3 Unauthorized Access Fee. TCG may assess a fifty-dollar ($50.00) unauthorized access fee per unauthorized guest, per day, representing reasonable administrative and security costs, in addition to actual damages and suspension or termination where permitted by law.

9. CLEANUP FEES, DAMAGE CHARGES, AND OTHER COSTS

9.1 Condition of Premises. Member shall leave the facility clean and orderly and shall respect all furniture, fixtures, equipment, access systems, displays, security devices, and improvements.

9.2 Standard Cleanup Fee. TCG may charge a standard cleanup fee of fifty dollars ($50.00) for trash, food or drink messes, improperly rearranged furniture, or similar conditions requiring staff cleanup beyond ordinary use.

9.3 Major Cleanup Fee. TCG may charge up to three hundred dollars ($300.00), plus documented third-party costs if greater, for bodily fluids, biohazard-type messes, contamination, carpet or upholstery cleaning, sanitation, extraordinary staff time, or other major cleanup.

9.4 Property Damage. Member is responsible for the reasonable repair cost or replacement value of TCG property damaged by Member or Member’s guests, as determined by TCG in good faith.

9.5 Itemized Notice and Payment Authorization. Member authorizes TCG to charge the payment method on file for amounts permitted under this Section. TCG will provide an itemized notice or receipt describing the charge. 

10. RULES OF CONDUCT

· Member and guests shall comply with all posted rules, occupancy limits, safety requirements, event rules, and reasonable staff instructions.

· Illegal activity, theft, fraud, gambling prohibited by law, possession of unlawful weapons, controlled-substance activity, or other unlawful conduct is prohibited. Alcohol, tobacco, vapes, and TCG/CBD products are prohibited in the shop and play area. 

· Threatening, abusive, harassing, discriminatory, dangerous, sexually inappropriate, or materially disruptive conduct is prohibited.

· Member and guests shall not damage, deface, misuse, remove, conceal, or tamper with TCG property, merchandise, security systems, alarms, locks, smoke detectors, cameras, emergency exits, or access controls.

· Unapproved commercial activity, private events, soliciting, sleeping, overnight occupancy, and use of the premises for storage are prohibited.

· Violation of this Section may result in immediate removal, access deactivation, suspension, termination, law-enforcement contact, and assessment of applicable charges.

11. SECURITY CAMERAS AND NO EXPECTATION OF PRIVACY

11.1 Surveillance. Member understands that entrances, exits, retail areas, play areas, and other common areas may be monitored or recorded by security cameras and access-control systems for safety, loss prevention, rule enforcement, and investigation of incidents.

11.2 Privacy. Member has no expectation of privacy in store common areas. TCG will not intentionally place cameras in restrooms or other locations where surveillance is prohibited by law.

12. ASSUMPTION OF RISK AND RELEASE OF LIABILITY

   

RELEASE OF LIABILITY — PLEASE READ CAREFULLY

12.1 Assumption of Ordinary Risks. Member understands that use of the premises, play area, tables, chairs, flooring, doors, restrooms, access systems, parking areas, and common areas may involve risks, including slips, trips, falls, illness exposure, theft, property loss, physical confrontation, and injury associated with unstaffed after-hours access. Member knowingly and voluntarily assumes the ordinary risks of entering and using the premises.

12.2 Release for Ordinary Negligence. To the fullest extent permitted by Washington law, Member releases and waives claims against TCG and its owners, members, managers, employees, agents, contractors, successors, and assigns for negligence arising from Member’s voluntary use of the premises or participation in store activities, including after-hours use.

13. INDEMNIFICATION

13.1 Member-Caused Claims. To the fullest extent permitted by law, Member agrees to indemnify and hold harmless TCG and its owners, members, managers, employees, and agents from third-party claims, liabilities, losses, damages, costs, and reasonable attorneys’ fees arising from Member’s breach of this Agreement, Member’s misconduct, unauthorized access provided by Member, or property damage or injury caused by Member or Member’s guests. This provision does not require Member to indemnify TCG for TCG’s gross negligence, reckless conduct, or intentional misconduct.

14. MINORS AND AFTER-HOURS ACCESS

14.1 General Age Requirement. Membership and unaccompanied after-hours access are intended for persons eighteen (18) years of age or older.

14.2 Written Exception. TCG may, in its sole discretion, approve a minor for membership only with prior written approval and a separate signature from a parent or legal guardian. TCG may impose additional conditions or revoke approval at any time for safety or operational reasons.

14.3 Guardian Presence After Hours. Unless TCG provides a specific written exception, a minor may not use the premises outside posted staffed hours unless accompanied by the minor’s parent or legal guardian, who must remain physically present and responsible for the minor.

14.4 No Waiver of Nonwaivable Minor Rights. Nothing in this Agreement is intended to waive any claim or right of a minor that cannot legally be waived by the minor or the parent or guardian.

15. PERSONAL PROPERTY; NO BAILMENT

15.1 Member Property. TCG is not responsible for lost, stolen, misplaced, or damaged cards, decks, binders, electronics, bags, cash, vehicles, or other personal property brought onto or left at the premises.

15.2 No Storage or Custody. TCG’s allowance of personal property on the premises does not create a bailment or agreement to safeguard the property. Items left behind may be handled under TCG’s posted lost-property policy and applicable law.

16. CANCELLATION BY MEMBER

16.1 Cancellation Methods. Member may cancel through an in-store request, email, online account cancellation, or another cancellation method authorized by TCG. TCG will provide written or electronic confirmation when reasonably practicable.

16.2 Deadline to Stop Renewal. To prevent the next monthly renewal, TCG must receive the cancellation request no later than 11:59 p.m. Pacific Time on the final calendar day of the current month.

16.3 End of Access. Cancellation stops future renewal. Access and benefits remain active through 11:59 p.m. on the final day of the paid calendar month unless access is suspended or terminated for breach, nonpayment, safety, or security reasons.

16.4 No Refund for Incomplete Month. No refund or credit will be issued for an incomplete month, voluntary cancellation, unused access, or unused benefits, except where required by law.

17. SUSPENSION OR TERMINATION BY TCG

17.1 For Cause. TCG may immediately suspend or terminate membership, access, or benefits for (but not limited to) nonpayment, chargebacks, suspected fraud, misuse of access credentials, unauthorized guests, unsafe conduct, rule violations, property damage, false identification, harassment, criminal activity, or another material breach. Except where required by law, no refund is due for termination based on Member breach, misconduct, fraud, safety concerns, or damage.

17.2 Without Member Breach. TCG reserves the right to cancel any membership regardless of cause or breach.

17.3 Outstanding Obligations. Termination does not eliminate Member’s responsibility for unpaid charges, cleanup fees, damage charges, unauthorized access fees, keycard replacement fees, or other amounts validly incurred before termination.

18. CHANGES TO PRICES, BENEFITS, RULES, OR TERMS

18.1 Material Changes. TCG may change membership prices, material benefits, or this Agreement by providing at least thirty (30) days’ notice before the change takes effect at a future renewal. Member may cancel before the effective date. Notice will be posted in store and in public view. This will serve as reasonable notice. 

18.2 Immediate Operational Changes. TCG may make immediate changes reasonably necessary for safety, security, legal compliance, manufacturer or distributor requirements, organized-play requirements, fraud prevention, product allocation, or prevention of abuse.

18.3 Posted Rules. TCG may update house rules and access procedures from time to time. Continued use after notice of a valid update constitutes acceptance to the extent permitted by law.

19. NOTICES, ELECTRONIC RECORDS, AND ENTIRE AGREEMENT

19.1 Notices. TCG may send membership notices to the email address or other contact information on file, through the Member’s account, or by posting notices at the premises when appropriate. Member is responsible for maintaining current contact information.

19.2 Electronic Signatures. Electronic signatures, electronic authorizations, and electronic records may be used and shall have the same effect as paper records to the extent permitted by law.

19.3 Entire Agreement. This Agreement, the selected membership tier, posted house rules, applicable loyalty-program rules, and any signed addenda constitute the entire agreement concerning membership and supersede prior oral or written understandings on that subject.

19.4 No Waiver. TCG’s failure to enforce a provision on one occasion does not waive its right to enforce that provision or another provision later.

20. GOVERNING LAW, VENUE, AND SEVERABILITY

20.1 Washington Law. This Agreement is governed by the laws of the State of Washington, without regard to conflict-of-law principles.

20.2 Venue. Any dispute arising from this Agreement shall be brought in a court of competent jurisdiction in Washington State, unless applicable law requires otherwise.

20.3 Severability. If any provision is held invalid or unenforceable, the remaining provisions remain effective to the fullest extent permitted by law, and the invalid provision shall be interpreted as closely as possible to its lawful purpose.
